1. Introduction and Acceptance

Welcome to Digital Lane LLC ("we," "us," "our"), provider of interactive educational media apps for children, including Magical Stories: Kids Books (collectively, the "Services"). These Terms of Service ("Terms") constitute a legally binding agreement between you, the parent or legal guardian ("Parent," "you"), on behalf of yourself and your child ("Child," "User") and Digital Lane governing your access to and use of our Services.

By downloading, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Digital Lane specializes in creating engaging, educational media apps for children. Our collection focuses on interactive bedtime stories and kid-friendly applications designed to stimulate imagination while providing a safe digital environment.

Our primary offering includes:

• Magical Stories: Kids Books: Interactive bedtime stories that help children wind down with soothing narration, gentle animations, and customizable story elements.

Digital Lane reserves the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Services without liability.

Our Services are designed for children aged 3-18, often with parental involvement and guidance, particularly for younger users.

3. Children's Online Privacy Protection Act (COPPA) Compliance

• Create more than one account per Parent (unless explicitly permitted)

• Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services

5. Content and Intellectual Property

All content within our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Digital Lane or its content suppliers and is protected by United States and international copyright laws.

License to Use: Subject to your compliance with these Terms, Digital Lane grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal, non-commercial purposes.

User-Generated Content: Some Services may allow Users to create, post, or share content ("User Content"). By creating User Content, you retain all rights in your User Content, but grant Digital Lane a worldwide, non-exclusive, royalty-free license to use, copy, modify, create derivative works based on, distribute, publicly display, and publicly perform your User Content for the purpose of operating and providing the Services.

You represent and warrant that:

To maintain a safe and appropriate environment for children, Digital Lane reserves the right to moderate any User Content submitted within our Services:

• Content Removal: We reserve the right to refuse, modify, or remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or otherwise inappropriate, especially for our young audience.
• Reporting Inappropriate Content: Users and Parents can report inappropriate content using the in-app reporting features or by contacting us directly.

Our content moderation standards prohibit:

• Content containing profanity, adult themes, or explicit material
• Content promoting discrimination, hatred, or violence

• Content that encourages illegal or harmful activities

8. Purchase Terms and Subscription Information

Some Services may offer in-app purchases or subscription options. For such Services:

• Pricing and Payment: All prices are in U.S. Dollars unless otherwise specified. Prices may change at any time. Payment is processed through third-party app stores (e.g., Apple App Store, Google Play Store) and subject to their terms.
• Parental Control: We recommend that Parents use the parental controls available on their devices to prevent unauthorized purchases.
• Cancellation: Subscription cancellations must be made through the third-party app store account settings. Refunds are subject to the policies of the respective app stores.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You will be charged for renewal within 24 hours prior to the end of the current period.

Digital Lane does not collect or process payment information directly. All payment transactions are handled by third-party app stores.

9. Privacy and Data Practices

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Digital Lane does not warrant that:

• The Services will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Services are free of viruses or other harmful components
• The results of using the Services will meet your requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIGITAL LANE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or consequential damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Digital Lane, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

13. Dispute Resolution and Arbitration

Informal Dispute Resolution: Before filing a claim against Digital Lane, you agree to try to resolve the dispute informally by contacting us. We will try to resolve the dispute by contacting you via email. If a dispute is not resolved within 30 days, you or Digital Lane may initiate formal proceedings.

Binding Arbitration: Except for disputes in which either party seeks to bring an individual action in small claims court or seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property, you and Digital Lane agree to resolve any disputes through binding arbitration in accordance with the American Arbitration Association's rules for consumer arbitration.

Arbitration Procedures: Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association's rules, which are available at www.adr.org. The arbitration shall be held in Travis County, Texas, or at another mutually agreed location. The arbitration shall be conducted in a manner that preserves confidentiality.

Class Action Waiver: YOU AND DIGITAL LANE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Digital Lane agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a class or representative proceeding.

30-Day Right to Opt Out: You have the right to opt out of the provisions of this Arbitration Agreement by sending written notice of your decision within 30 days after first accepting these Terms.

14. Force Majeure

Digital Lane shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond our reasonable control, including, but not limited to:

• Electronic or mechanical equipment failures
• Telecommunication failures
• Software, hardware, or server malfunctions
• Computer viruses or other malicious code
• Acts of God, natural disasters, epidemics, or pandemics
• Labor disputes or shortages
• War, terrorism, civil unrest, rebellion, sabotage, or the acts of third parties
• Governmental actions or restrictions

In the event of such failure, our obligations under these Terms will be suspended for the duration of the force majeure event. We will take reasonable steps to minimize disruption and restore our obligations as soon as reasonably possible.

15. Termination

Digital Lane may terminate or suspend your access to all or part of the Services, without notice, for any conduct that Digital Lane, in its sole discretion, believes violates these Terms or is harmful to other users of the Services, Digital Lane, or third parties, or for any other reason.

You may terminate your use of the Services at any time by uninstalling all Digital Lane applications from your devices. Termination does not relieve you of any obligations arising or accruing prior to termination.

16. Governing Law and Jurisdiction

These Terms and any disputes relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Subject to the Arbitration Agreement in Section 13, you agree to submit to the personal and exclusive jurisdiction of the courts located in Travis County, Texas for the resolution of any disputes arising out of these Terms or the Services.

17. Changes to Terms

Digital Lane reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

18. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of the Terms will continue in full force and effect.

19. Entire Agreement

These Terms, our Privacy Policy, and any other agreements expressly incorporated by reference herein, constitute the sole and entire agreement between you and Digital Lane regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
